For example, renovations, late payments, car park, etc

For water leakage from upper floor, can the owner in lower floor claim the cost of his own belongs damaged by the leakage?
The court seems to say YES!
Then how to avoid over claim?

how about this :

a resident smelled BBQ and complained to MCST that A unit is BBQing in his balcony.

MCST sent security to check... found nothing...

case close ??


NO

MCST issued a Warning letter to unit A

A demanded an explaination...

non given ....

culprit was the chairman of council ..who has a history with A ...

can sue ???

Everything needs to have evidences.
For MCST, they need the following evidences:
1) resident complain letter, WhatsApp, sms or security guard's testimony that it is truly a resident is complaining;
2) any pictures showing A is BBQing in his balcony.

For A, he needs the following evidences:
1) No BBQ equipment at home! (Ok, that may not be possible);
2) security testament that no BBQ found at balcony;
3) other sources of the BBQ smell (so indirect prove not from his balcony);
4) documents showing A and Chairman had a history, for example, previous STB cases,etc
5) details of the MCST warning letter and which facts were wrong;

Anyway, a warning letter doesn't carry water (unless it is from a lawyer of MCST/MA which can mean further legal actions)

Not suggest to sue because normally STB will order each side to pay their own costs and it will be a loss-loss.

Open for comments - not a trained lawyer myself.

Another point: MCST, council and the individual (holding chairman's position) are 3 different legal entities.
If the letter is from MCST or council, it is very hard to sue the individual (chairman) unless you have hard evidences.
